Website and enquiry terms
These terms cover your use of the website at hampshiresubsidence.co.uk, together with any enquiry you send through it. The site is published by Hampshire Subsidence. By reading the pages or using the form, you are accepting what follows, so please have a look before you do either.
What you have come to
Hampshire Subsidence sets out what causes ground movement under buildings, how the damage tends to show, and what is usually done about it. At the end of that explanation there is a form. subsidence We are a publisher and an introducer, not the firm that turns up: we carry out no inspections, no monitoring, no underpinning and no repairs of any kind.
The pages and who owns them
Reading is free, and printing a page to take to a surveyor, an insurer or a relative is entirely fine. The text, photographs, layout and underlying code are owned by Hampshire Subsidence or by whoever licensed them to us. What we ask you not to do is republish any of it, put our pages inside a frame on another site, run scrapers or bulk collectors over it, or use it in a way that misleads people about where it came from.
Why nothing here is advice about your building
These pages are general reading. They have never seen your soil, your drains, your foundations or the tree at the end of the garden, and they cannot. subsidence Nothing published here is a survey, a report, an insurance opinion or advice on a particular property, and it should not be treated as a substitute for someone competent coming out and looking at the building.
What happens when you use the form
Filling in the form costs you nothing, obliges you to nothing, and brings no contract into being between you and us. Your enquiry, with the details you gave, is passed to one specialist firm covering the area you told us about, so that they can contact you about it. They use it only to answer your enquiry and to arrange any visit or work you agree with them, and from that point they are responsible for how they handle it. We do not pass your details to anyone else for their own use. From that point, whatever is arranged (a visit, an investigation, a quotation, the work itself) is a matter between you and that firm, on that firm's own terms and conditions. We are not a party to it. The specialist may pay us when we pass the enquiry on. You pay us nothing, and you are free to get quotes from anyone else. You remain entirely free to approach other firms and gather as many other quotes as you like.
The firm that contacts you
That firm stands behind its own conduct: the inspection it performs, the advice it gives, the price it quotes, the work it carries out and any guarantee or warranty it offers. If something about the work goes wrong, raise it with them first, because they are the ones who can put it right, and we would like to know as well, since it tells us something about who we are passing enquiries to.
What we can and cannot promise about the site
We take trouble over what is published here and we would rather the site were up whenever you want it. Even so, we do not promise that every page is complete, current or free of error, nor that the site will always be available. Pages may be edited, moved or taken down at any time without notice.
How far our responsibility reaches
So far as the law allows, we are not answerable for loss, cost or damage arising from your use of this site, from reliance on anything published here, or from your dealings with a specialist firm we passed your enquiry to. Nothing in these terms limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for anything else the law does not permit us to limit or exclude. If you are a consumer, nothing in these terms takes away the rights the law gives you, including your rights under the Consumer Rights Act 2015.
Where we point elsewhere
From time to time a page links to another website, a trade body, an insurer's guidance, a government page. Those sites are run by other people, we have no control over what appears on them, and a link should not be read as a recommendation or an endorsement of anything they say or sell.
If we amend these terms
These terms may be rewritten from time to time. The version showing on this page when you use the site is the version that applies to that use, and any change we make later does not alter the position on an enquiry you have already sent.
Law and courts
These terms, and any dispute about them or about the site, are governed by the law of the place where we are established, and the courts there have jurisdiction. If you are a consumer, that does not take away your right to bring proceedings in the courts of the country where you live.
Putting something to us
A question about these terms, a page that looks wrong, or unhappiness about how an enquiry was dealt with should come to us through the contact page, and we will look into it. Where the complaint concerns your personal information, this is the route it takes: If you complain to us about how we have handled your personal information, we acknowledge it within 30 days and reply as soon as we can.
